In recent beading magazines I have noticed this big thing on copyright on "art" items.

Things like, "you shouldn't make a copy of someone else's work" to "you shouldn't teach a class form something out of someone else's book".

I have got to wonder why someone would write a book if they don't want someone else to use it. One letter I read (I believe it was sent to Beadwork mag) was from an author of a book that was offended that a bead store offered a class in how to do something from her book and didn't ask permision first. I was left wondering why she even bothered to write the book! I know the local quilt store here does teach classes from books, but atleast requires you to purchase the book the teacher is using in the class.

What has happened to people just sharing how they did something?

Hello!

I was talking about this (again) a few days ago :)

It was in response to a response to a letter in Wire Artist Magazine about copyright. It's amazing how many people -- especially authorities -- get it WRONG!! :)

You can't copyright a design. Only the "item" itself. This is a tough concept. You can also copyright the diagrams, directions, etc., but only to the point of the actual words/layout.

People often resort to Disney and their license on kits. The reason Disney can do it (besides having more money than even Bill Gates), is that they have TRADEMARKS on the characters, logos, etc. TRADEMARKS are where the problems lay.

So, while this is not a copyright lesson -- though we could start one :) (I was/have been involved in many, many intellectual rights forums since the first days of computers and BBS's, especially in the area of IMAGE/GRAPHIC copyright.), I do want to point out that there is so much misinformation that it's almost laughable.

I *think* I posed a "vent" here a few months ago about one of the other forums on-line where the ladies (I use that term pointedly and loosely) would come back after a weekend show, and complain that someone looked at one of their items too long, or similar silliness. They were venting bile about how rude it was and horrible, and how they wanted to draw and quarter the person -- then in the next breath talk about how badly they did at the show <G>! Maybe their hostility showed through? Anyway. One of major pet peves, and why I don't usually participate in "foreign" forums ;)

Also, it's amazing how when you do some research you can find similar (or the same) designs these people are griping about being stolen from them in some other magazine, old photos, etc.

Minor differences aside, there is _very_ little new. It's recombination of old.

We just went rounds and rounds over copyright with someone, and ended-up having to get a copyright lawyer to take care of it. Everything was settled, and now we know what we have to look forward to with our designs.

So....we put all our patterns in one book, had the whole book copyrighted, and that takes care of all our patterns at once.

I also visit other forums on the web, and this subject has come-up many, many times. My suggestion to people worried about copyright infringment, or anything that has to deal with their piece of work, is to contact a copyright lawyer and ask them specifically. They are usually more than happy to help you out for a small fee.
